Hatfield Road Flitwick, adjacent to no 1 Ivel Way
Reported via Android in the Pavement and Cycle path category anonymously at 23:12, Wed 5 June 2024
Sent to Central Bedfordshire Council less than a minute later. Council ref: 407764.
The hedge has substantially overgrown the pavement making the path impassable for mobility scooters, wheelchair users and other mobility aid users.
At the widest point, it is over 4ft over the pavement. If yoy look closely at the hole cut in the hedge by Virgin Media and Anglian Water, you can just about see the sluice valve concrete sign at what is actually the back if the path, many feet in to the hedge.
The council needs to issue a notice to the owner of the property under the Highways Act 1980 to address the issue. This act gives the authority the power to compel the owner to address the issue.
Please do not peddle the lie regarding funding. All it will initiwlly take is the cost of a letter. Additionally, if the resident refuses to act and the council caries out the work, the 1980 Highways Act allows you to claim back the full price of the works plus costs from the resident.
As a disabled person that uses a mobility aid and who wishes to use this footway, I must remind you of your responsibilities u der the Equality Act. By failing to remedy this issue you are discriminating against me as a user of your service as you are preventing me from accessing this path and thus causing me to have to take a longer route due to the positioning of available drop kerbs.
Therefore I am requesting this works be carried out as a reasonable adjustment do I can have the same access as a non disabled person.

It's now the 24th July. No action has been taken since the letter was issued on 7th June. Enough time had passed for the Authority to now invoke the Highway Act and carry out the work themselves.

Hello - i'm picking this one up from a colleague who has since left the Council. I can't find a record of the letter or whether a follow up letter was sent. The property is under Grand Union Housing ownership, i'll therefore be contacting them directly to request that the vegetation around the perimiter of the property are suitably cut back to allow for mobility scooters etc. to have sufficient space.
State changed to: No further action
