Sent to Central Bedfordshire Council less than a minute later. Council ref: 410124.
URGENT CALL---The tree is by the side of the road(public) and the roots has grown into my car park and started damaging my driveway paving. Can this be attended to urgently before it gets to the house, I will need the tree and the roots removed , also my paving fixed because I cant park car at the moment. Ade called for an update as he said The root has grown across the path into the car park and is lifting up the road. The more it grows the more damage it causes. I did mention it takes up to 28days for trees to be looked at.

Customer has called in again regarding the roots of the tree destroying his paving. He would like this to be inspected.

Even if the cause of the damage may appear to be obvious, CBC Highways require proof that the tree(s) is responsible for causing damage to property. Cases of damage or subsidence must also go through our Insurance team within the Council so we can be advised on how to action the issue.
We'd advise the customer speaks to their building insurers and makes a claim for damages to be sent to our Insurance Team.

Customer called to advise that the tree roots are growing towards the house.
They have spoken to their property insurer as mentioned in the reply to the report however they have advised that they won't take on the case as its too bigger job and there could be pipes and cables underground and suggested contacting the council again.State changed to: Open

Unfortunately, as per the last update - we cannot remove the tree unless we have proof that it is the roots causing the issues, and we are advised by the insurers that it's the most appropriate action to take, as tree removal can often lead to further damage.

If our tree is suspected to be the cause of the damage, we need proof of it, and will not prune/remove a tree or take any action to the roots without this proof. We are not structural engineers, so we won't be able to conclude on site whether our tree is responsible for any damage. This is where your building insurers should help by investigating the cause of the damage - if it is proven that our roots are responsible, they should be able to advise how repairs can be made to the driveway, and what action CBC should take regarding the tree IF it is proven to be the cause of the damage.
CBC don't carry out work on private property, such as root removal or driveway repairs, we are not responsible for carrying out that work. If damage is being caused to your property, you/your insurers are responsible for any repairs - these repair costs can be submitted by your insurers, to our insurers, who will then discuss the claim and who is liable for the costs. A tree officer inspecting this tree won't change this as this is all built into our Policy. It's the information we require to act on cases of property damage, where a council owned tree is suspected to be the cause.
