Updates

  • Thank you for letting us know about this matter. We have contacted the landowner about this to understand why a gate has been installed. Gates across public rights of way are covered by Section 147 of the Highways Act: https://www.legislation.gov.uk/ ukpga/ 1980/ 66/ section/ 147 . They must be authorised by the Council and can only be authorised for specific purposes. There are also provisions for barriers under Section 66 of the Act https://www.legislation.gov.uk/ ukpga/ 1980/ 66/ section/ 66 but this usually relates to urban locations where guardrails are necessary where paths exit onto busy roads near schools

  • The landowner has been contacted and informed the gate is an obstruction. A gap has been provided to the side. We will continue to monitor this going forward.
