Dangerous rights of way. Reports of yesterday a horse got stuck.

Hi. I think the pin is in slightly the wrong place. I believe this is Public footpath no. 14 running downhill from the church to high road. As a footpath, horses should not be using it. The landowner would be responsible for any kissing gates or structures to stop any grazing horses reaching the bridge. The bridge is on our replacement list. I will arrange for the path to be temporarily closed on safety grounds while we wait for the work to be carried out.

The path is now temporarily closed. The Council is only responsible for the bridge itself. Structures such as stiles and gates across public rights of way are the landowner's or tenant's responsibility to maintain rather than the Council's under Section 146 of the Highways Act 1980 - https://www.legislation.gov.uk/ ukpga/ 1980/ 66/ section/ 146 - it would therefore be up to the landowner or owner of the horses to fix or replace the kissing gate to stop their animals getting onto the bridge. They can choose to do this now or contact us to have a discussion with us so that they can do this when the bridge is replaced.
