Sent to Central Bedfordshire Council less than a minute later. Council ref: 13134.
There is a fence that runs along the side of mine and my neighbours rear access. The fence which runs along the lane between Cromer way and old Bedford Road has been pulled over by central Bedfordshire’s poorly maintained hedges. The lane is completely overgrown and the fence being pulled over compromises the houses security. The fence is on central beds land and within your boundary. I have attached a screenshot from the council boundary map for reference. The fence is not owned by myself or my neighbours, it is central beds, it’s is dangerous having the fence fallen over and leaning right over in other parts.

Thank you for your report. The screenshot you have provided does not show ownership, just the Luton/Central Bedfordshire Council local authority boundary. There are no CBC owned properties in this area. The lane is a public highway but fences are boundary features, not highway features so it is very unlikely the fence would be the Council's to maintain. Your property deeds should set out/show all fences and outline who is responsible for them.

I have already checked my deeds as has my neighbour and this fence is not part of our land or responsibility. Besides, it is CBCs hedging that has pulled the fences over and caused the damage. This has comprised security for myself and my neighbours and presents a hazard as the fence further along the lane is leaning over into the access path and has the potential to cause injury.

Sorry but public highways - roads and footways - do not include/require fences and so you would have to provide some documentary evidence that it is a Council fence. Hedges and fences are two seperate features and is unfeasible that a hedge would pull down a well maintained garden fence.

Have to been out to visit the site? If you have then I am struggling to see how you could conclude anything other than the poorly maintained council hedge being responsible for pulling the fence over. Myself and my neighbours have reported the overgrown hedge many times and had the issue been dealt with when it was first raised the damage would not have been so extensive. If you are not able to handle this issue yourself, please escalate it to the appropriate line manager.
